Chirp Up’s – Bird Image Library Terms & Conditions

Chirp Up invites you to contribute your photography and-or artwork to our bird image library in one of two ways:

Public Option: you can grant Chirp Up the right to include your images in:

(i) our public-facing gallery, and (ii) our social media, or

Private Option: you can grant Chirp Up the right to make your images available only to: ‘

other contributors, (ii) Chirp Up staff, and (iii) a limited number of third parties.

Either way:

· You will retain all rights to your Images,

· You may withdraw your Images at any time in your discretion,

· Whenever Chirp Up uses your Images, you will be attributed, and

· The Chirp Up team will look for potential promotional and commercial opportunities, but will not make any such use of any of your Images without your prior written approval,

Terms and Conditions: please select one option:

Public Option: Chirp Up Bird Image Gallery and Social Media:

I hereby grant to Be Good Studios, llc. (dba “Chirp Up”) a non-exclusive, worldwide, royalty-free license to include the photography and-or artwork that I upload to this database (“My Images”) along with any accompanying data that I may provide, in Chirp-Up’s public-facing gallery and its social media content.

Chirp Up acknowledges and agrees that: (i) it will make no other use of My Images without my prior written approval, (ii) I retain the Copyright and all other rights to My Images, (iii) I may withdraw My Images at any time in my discretion, and (iv) whenever Chirp Up uses any of My Images, I will be attributed.

I warrant that My Images are either owned by me or in the public domain. I agree that: (i) I will hold Chirp Up harmless from any claims of ownership or infringement of My Images by any third party, (ii) I am solely responsible for protecting My Images from infringement by any third party, i.e., that Chirp Up is not responsible for pursuing such claims on my behalf, and (iii) Chirp Up may, in its discretion, choose not to use any of My Images.

Private Option: Chirp Up Bird Image Gallery and Social Media:

I hereby grant to Be Good Studios, llc. (dba “Chirp Up”) the right to include the photography and-or artwork that I upload to this database (“My Images”) along with any accompanying data that I may provide, in Chirp-Up’s digital database and to provide access to My Images only to (i) other contributors to the database, (ii) Chirp Up staff, and (iii) a limited number of third parties.
